TERMS OF SERVICE

ADOPTABLES - AN OVERVIEW OF TERMS AND CONDITIONS AS APPLIED.

Unless stated within posting, all payments should be made in USD through PayPal.com (I will invoice you). With the purchasing, rights to the designs are given upon verification of received payment along with copies of purchased design. After purchase the owner will then receive digital copies of the assets included in the adopts package unless stated (as sometimes time passes and files get lost / corrupted.) However, in many cases this will include a non-watermarked version of the adopt and separate .PNG’s of any chibi, headshot / bust, full body, or tattoo designs where applicable.


All payment MUST be received within 24 hours of closing and claim of purchase. If not, sale will continue to the next bidder / purchaser. If there are legitimate circumstances behind inability to pay right away, please communicate. As sometimes deals might be able to be worked out and accommodations met. 

 ALL ADOPTS WHETHER FROM BASE OR A STAND ALONE ONCE PURCHASED WILL HAVE TO ADHERE TO THE FOLLOWING TERMS:

  1. Owner CANNOT re-upload design and artwork without proper credit or claim the work as their own.

  2. Owner CANNOT change the original design file to a point of unrecognition

  3. Owner CANNOT change original design file for resell. 

  4. Owner CANNOT resell, trade, or gift design without notification.

  5. Owner CAN make minor changes to the design file upon purchase.

  6. Owner CAN change the designs outfits, gender, ect upon purchase

  7. Owner CAN use the design in non-commercial works. 

  8. Owner CAN change use the art of the design in icons, profile pics, ect.

  9. NO ONE IS PERMITTED TO MINT / SELL ADOPTS FOR NFTs. 

    If terms are broken and not adhered to, I (L0AFofBR3AD) retain rights to blacklist, reclaim the design, and refuse ownership of said design. Upon reclaiming, I hold rights to relist the adoptable for sale as well as the assets involved with the design.  In case of Chagebacks or Blacklists, one will be publicly blacklisted and to recuperate losses, the design will be reclaimed and be put back up for sale.

    If commercial use for-profit arises and seems to become of interest, communications can be opened up, and options discussed. With commercial rights one may be granted the ability to use the design in prints, posters, t-shirts, keychains, or other merchandise. 

COMMISSIONS

By commissioning me in any kind of way, you are agreeing to the terms of service below. And statements can be bound to change if discussed with me, L0AFofBR3AD, prior to the commission.

GENERAL TERMS

  1. Contact:
    I will only accept commissions initiated through my order form. This is so I can keep my queue neat and orderly. Once a client has filled out the form, I will email or DM  to discuss the order.
     

  2. Discussion of Commission:
    I will not discuss any matter pertaining to the commission with the client in any medium other than through email, DM, notes on DA, or instant messenger if necessary. Once I have accepted the client’s commission, I will not answer comments regarding it in public spaces.
     

  3. Obtaining a slot:
    I will decide how many commissions I take at one time. Generally this will be no more than five. I will not open a new set of slots until my current one is completed. Slots are filled on a first come, first serve basis of those I CHOOSE. I will only fill slots after the client has filled out the order form, I approve and accepted it, and the client has made payment.
     

Waiting List Policy:
As of now, I do not offer a waiting list service. If you are interested, please keep an eye open on the progression of the opened or closed slots.

WHAT I WILL AND WILL NOT DRAW:

  1. I will not draw any of the following:
    - Minors or characters depicting a minor in any NSFW scenario.
    - Any character who I feel resembles a minor in a NSFW scenario.
    - Feral and non-sentient creatures in NSFW scenarios.
    - Any character from a children’s show in a NSFW scenario.

    - Various sexual fetishes including:
           - Digestion
           - Scat
           - Rebirthing
           - Feeding
           - Hyper gore
           - Rape.

    - Politically charged symbols, slogans, or iconography regardless of leanings or party represented.
    - Babies / infants (Simply due to my own lack of skill in this region)
    - Elders (Also due to my own lack of skill in this region)
     

  2. I will draw any of the following:
    - Mecha

    - Humans:
           -Any ethnic, religious or spiritual symbol or iconography as long as it is not meant to represent hatred or bigotry.
           -Any sexual orientation, leaning, or identity
           -Hermaphrodite and third-sex characters

    - Anthros
    - Fanart

    - Gore:
            -Non pornographic within reason
            -Cryptids, creatures of myth, lore, ect in which is it a staple
                                          (such as zombies)

    - Slight NSFW (Depends on my own comfort levels)
    - Animals (pets, ect)

     

  3. If there are questions about what I will and will not continue through with and draw, please reach out to me. It it vital that something may of been overseen on the list or not clarified on.


PAYMENT

  1. All commissions must be paid in full upfront.

  2. Currency accepted is USD.

  3. Payment will be done through a Paypal INVOICE. I will send one in accordance to ensure I can keep things neat and organized when taxes roll around.

  4. If no payment is sent, I will reserve the client a spot on the queue for 7 days. After that, I will remove the placeholder and the process must start over again.

PROCESS

  1. I must receive payment and ALL reference images and/or text descriptions before I begin any work.

    I will assume that when payment is sent that i have all reference images required. Character sheets for references are preferred, but not always necessary. Images done by other artists, text descriptions, and animals /object/clothing references from Google are fine with me. If these are not given, I will have to omit the piece or detail, if something is necessary, tell me. I am not responsible for changing things on a commission later due to the client’s oversight on a detail.
     

  2. Work In Progress may be given if the commissioner personally asks for it and/or the price exceeds $60.
     

  3. WIPs may also be given if I have questions or curiosity about the commission and wish for clarification. Whether that may be for pose, detail, ect.
     

  4. Time for commission to be completed may take up to 2 months depending on a variety of factors such as:

    Health
    Order of commission
    Complexity
    Work (as I usually have multiple IRL jobs, gigs, events going on at a time)
    Family issues
     

  5. If time is longer than 1 month til the completion of a commission, I will notify the commissioner of any issues, hindrances, and problems.

CUSTOMER SATISFACTION

  1. I guarantee to do my best to ensure a happy customer
     

  2. After a commission is finished, only small changes are allowed to be made.
            Such as colouring / marking mistakes
     

  3. Any great and significant changes will come with an extra charge.
           Such as an outfit change, outfit addition or subtraction, or anything that makes me have to redraw it completely again.
     

  4. If your reference(s) were not clear to start with, then you are not allowed to do minor changes without a fee. Please make sure to be extremely clear in your order in regards to what you aim for.

COPYRIGHT / USAGE POLICY

  1. I, L0AFofBR3AD, hold every right to the produced drawing, not the commissioner. Therefore I am allowed to use the copyrighted artwork to:

    Promote myself within any place or site

    Publish books with

    Display it anywhere to my liking

    Post it wherever I want
     

  2. Commissioners are allowed to:

    Use the copyrighted artwork for personal use only unless agreed otherwise. Print the art, and claim the right of their character(s) but not the drawing itself.

    Use the art to promote themselves with proper credit given to the artist.
    If you break the copyright infringement in any way, every right you had will be retracted.

     

  3. The following is considered copyright infringement:
    Reproducing / Using the copyrighted artwork commercially (meaning to make money off of it in ANY way)

    Taking credit for the creation of the artwork.

    Removing any watermarks / signatures.

    Altering the artwork without my, the artist’s, consent.
     

  4. Under NO circumstances, will I permit my works created even as commissioned works to be MINTED or put up for sale as NFTs.

PURCHASE OF COMMERCIAL RIGHTS TO THE ARTWORK WILL ALWAYS BE 300% OF THE ORIGINAL PRICE.

  1. With commercial rights, one is allowed to make any merch with the artwork. Use it in books, covers, props, and change as liked to promote ones own brand with. Credit is still required for using the artwork, even if alterations occur.

CANCELING / REFUNDING POLICY

  1. I have the right to cancel and refund money for your commission at ANY time and ANY stage of the process.

  2. You have no right to cancel or demand a refund from the artist under any circumstances after payments are received and progress has been started. This is liable and open for discussion, however, if I (L0AFofBR3AD) am at fault or knowing of inability to complete commission. 

  3. If money has NOT been sent yet, the commissioner has the right to cancel the commission. Prior to the process starting. 

  4. If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I will have the right to sell the copyrighted artwork to new buyers. 

  5. You will be forbidden to ever commissions me, L0AFofBR3AD, ever again.

  6. Your name will be publicly posted for others to watch out for.

ANY STATEMENT CAN BE BOUND TO CHANGE IF DISCUSSED WITH ME, THE ARTIST, PRIOR TO THE COMMISSION.

Clear and concise communication is key to a happy business relation. If you have any concerns or questions, I am always open to listen and to talk to. After all, I would rather find equal grounds and ensure a smooth experience that a nightmare scenario on both of our hands.
